1. Acceptance of Terms

By creating an account and using Pulse Athletics ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Service Description

Pulse Athletics is a training dashboard and decision-support platform designed for endurance and hybrid athletes. The Service provides:

  • Training plan management and workout tracking
  • Recovery and wellness monitoring
  • Integration with third-party services (Strava, Garmin Connect)
  • AI-powered coaching recommendations

IMPORTANT: The Service is not medical advice and does not replace professional coaching, medical consultation, or clinical diagnosis. All recommendations are informational only.

3. Account Responsibilities

As a user of the Service, you agree to:

  • Provide accurate and complete information during registration
  • Maintain the security and confidentiality of your password
  • Maintain one account per person (no duplicate accounts for the same athlete)
  • Use the Service only for lawful purposes and in accordance with these Terms
  • Be at least 18 years of age

You are responsible for all activities that occur under your account.

4. Coaching Disclaimer

The coaching features use large language models (OpenAI, Anthropic) to generate training recommendations based on your profile, workouts, and recovery data.

YOU ACKNOWLEDGE AND AGREE THAT:

  • AI-generated recommendations are informational only and not professional training or medical advice
  • You are solely responsible for determining whether to follow any recommendations
  • You should consult qualified professionals (coaches, physicians, sports medicine specialists) before making training decisions
  • AI models may produce inaccurate, incomplete, or inappropriate recommendations
  • We are not liable for any injuries, adverse outcomes, or losses resulting from AI-generated content

5. Garmin Integration Disclaimer

The Garmin Connect integration uses unofficial methods to access wellness and recovery data from your Garmin account.

YOU ACKNOWLEDGE AND AGREE THAT:

  • This integration is not affiliated with or endorsed by Garmin Ltd.
  • The integration may break or stop working at any time without notice
  • We are not responsible for any issues arising from Garmin account access
  • You use the Garmin integration at your own risk

6. Strava Integration

The Strava integration uses the official Strava API and is subject to Strava's terms of service. By connecting your Strava account, you authorize us to access your activity data in accordance with Strava's OAuth authorization flow.

7. Intellectual Property

Your Data

You retain full ownership of your personal data, including training data, activities, and health metrics. You may export or delete your data at any time via your account settings.

The Platform

Pulse Athletics retains all rights, title, and interest in the platform, including software, design, algorithms, and branding. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSE ATHLETICS SHALL NOT BE LIABLE FOR:

  • Training injuries, adverse health outcomes, or performance issues
  • Data loss (beyond reasonable backup and recovery efforts)
  • Integration failures or third-party service outages
  • Inaccurate or incomplete data from connected services
  • AI-generated content that is incorrect or inappropriate
  • Indirect, incidental, consequential, or punitive damages

Your sole remedy for dissatisfaction with the Service is to stop using it and delete your account.

9. Account Termination

By You

You may delete your account at any time via your Data & Privacy settings. A 30-day cooling-off period applies, during which you may cancel the deletion. After 30 days, your data will be permanently deleted.

By Pulse Athletics

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the European Economic Area (EU/EEA), including the General Data Protection Regulation (GDPR). Any disputes arising from these Terms shall be subject to the jurisdiction of the courts in the EU/EEA member state where the service operator is established.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide 30 days' notice via email before the changes take effect. Your continued use of the Service after the notice period constitutes acceptance of the updated Terms.
